I was happy with my position, and understood - and admitted - that it had grey areas and might well be wrong. The bit I was unsure about (whether assistance should have been provided during an unplanned stop) was prefaced with "I think". Why the hostility? | |

That's why I tried to phrase my earlier comment somewhat guardedly. I just found this earlier answer of mine that cited some important decisions but those were related to compensation, not assistance. You would need to study the exact reasoning used by the court and more recent decisions to find out more. | |

Aug 16, 2021 at 8:32 | comment | added | Relaxed | (+1) @MadHatter Case law extended these rights and I think a case could be made that article 9 assistance (refreshment, phone calls, even hotel rooms if the situation had lasted longer) should have been provided at Porto Santo even if the departure was on time. The problem with the OP's taxi ride is that it occurred after they finally reached their destination. Missed long-distance trains or expensive cruises do not fall within the scope of this “right to assistance” either. | |
